Bugsy’s Great Gear Giveaway (the “Giveaway”) Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN THE GIVEAWAY.  THE GIVEAWAY IS UNAVAILABLE AND Void in FLORIDA, NEW YORK, RHODE ISLAND, COUNTIES AND TERRITORIES OUTSIDE OF THE UNITED STATES, and where OTHERWISE prohibited. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING A PRIZE.

  1. Giveaway Description. Giveaway begins at approximately 5 p.m. E.T. on May 7, 2010 and ends at 11:59 p.m. E.T. on August 31, 2010. Entries must be received by 11:59 p.m. E.T. on August 31, 2010 (or postmarked no later than August 29, 2010 at 5:00 p.m. E.T. for mail-in entry). Entries become the property of Wisconsin Pharmacal Company, LLC, 1 Pharmacal Way, Jackson, WI 53037 ("Sponsor") and will not be acknowledged or returned.  The Giveaway will take place in the United States and DC, except in Florida, New York, Rhode Island and where prohibited. 
  2. Official Rules. By entering, entrants agree to abide by and be bound by these official rules ("Official Rules") and the decisions of the Sponsor, which shall be final and binding in all matters.  Entrants waive all rights and remedies at law or in equity of any claim they may have relating to this Giveaway.
  3. Eligibility. Legal residents of the fifty (50) United States, and the District of Columbia, eighteen (18) years of age or older are eligible to enter, except (a) residents of Florida, New York and Rhode Island, (b) officers, directors, employees or agents/ independent contractors of Sponsor, Celtic Inc., and The Coleman Company, or any affiliated company, (c) individuals engaged in the development, production or distribution of materials for the Giveaway, and (d) persons who are immediate family members (defined as spouse or biological or step- mother, father, sister, brother, daughter, or son and each of their respective spouses) of any person in the foregoing clauses (b) and (c), regardless of where they live, and/or individuals who reside in the same household, whether related or not, to any person in the foregoing clauses (b) and (c).  This Giveaway is void in Florida, New York, Rhode Island and where prohibited. All federal, state and local laws and regulations apply.
  4.  How to Enter.  No purchase necessary.  Only one entry per person.  No group entries.  There are two entry methods available.  You can register online by visiting www.ColemanRepellents.com and following the instructions to complete the registration.  You can also register through mail-in entry by handwriting your name, e-mail address, physical address, city, state, zip code and daytime phone number on a 3” x 5” index card.  Each entry card must be mailed in an addressed, stamped envelope to: Bugsy’s Great Gear Giveaway, c/o Celtic, Inc., 330 S. Executive Dr. Suite 206, Brookfield, WI 53005. No photocopies or mechanically reproduced entries will be accepted.  Enter using only an email address subscribed and registered in your name.  Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. 
  5. Prize Drawing/Odds. The winner of the Grand Prize, First Prize and Second Prize (each as defined below and collectively referred to as the “Prizes”) will be selected in a random drawing from all eligible entries properly received in accordance with the Official Rules.  The drawing will be conducted by the Sponsor or its designee on or about September 30, 2010 at 1 Pharmacal Way, Jackson, WI 53037 or as otherwise announced by the Sponsor.  The odds of winning the Grand Prize, First Prize or Second Prize will be determined by the total number of entries.  By accepting the Grand Prize, First Prize or Second Prize, the winner grants Sponsor and its designees the right to use the winner’s name, city and state of residence, likeness and other attributes for advertising, promotional and publicity purposes in any and all media now known or hereafter devised throughout the universe in perpetuity without further compensation, permission or notification and, upon request, will confirm such consent in a signed writing, except where prohibited. 
  6. Prizes: One (1) Grand Prize Winner will receive a set of Coleman camping gear and repellents. These Prizes are non-transferable and cannot be substituted or redeemed for cash, except as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value should any of the featured Prizes become unavailable.

  1. Winner Requirements and Notification.  All winners will be notified by email and mail.  The potential winner of each prize will receive an Affidavit of Eligibility, Liability and Publicity Release as well as a Federal Form W-9 that the potential winners will be required to complete, have notarized and return within ten (10) business days.  Each winner is solely responsible for any and all applicable fees, licenses, and registrations and federal, state, and local taxes associated with prize receipt and use.  If a potential winner is found to be ineligible, fails to return the completed and signed documents within ten (10) business days, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, or if a prize or prize notification is returned as unclaimed or undeliverable, such potential winner will be disqualified and an alternate winner may be selected.  Sponsor will wait for up to two (2) weeks for a potential winner to respond to our notification that his or her name has been drawn.  If the potential winner has not responded after two (2) weeks, Sponsor will draw a second name winner, and attempt to contact this potential winner using the email address he or she provided in the registration process.   The second potential winner will have two (2) weeks to reply. If there is still no confirmed winner after two attempts have been made, the applicable prize may go unawarded.  It is strongly recommended that potential winners make a copy of all materials submitted and obtain a receipt of mailing (although proof of mailing does not constitute proof of delivery).  Sponsor is not responsible if any documents or other submitted materials are not received for any reason. Each entrant acknowledges and agrees that the verification decisions of the Sponsor shall be final and binding in all matters relating to the Giveaway. If Sponsor so elects, a potential winner may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Giveaway will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Giveaway as determined by Sponsor in its sole discretion. All potential winners agree to cooperate fully in any such background check.  Winners will receive their prizes 8-10 weeks after Sponsor completes the required winner verification.
  2. Reservation of Rights; Disclaimer. Sponsor, Celtic Inc., The Coleman Company, and their affiliated companies and directors, officers, employees or agents, and individuals engaged in the development, production or distribution of materials or information relating to this Giveaway, including social media sites such as Facebook and Twitter (collectively, the “Releasees”) are not responsible for lost, late, mutilated, misdirected, incomplete, illegible entries, redemption requests or prize claims.  Postage due mail will not be honored.  Sponsor is not responsible for any computer system, or technical malfunction of any telephone lines, computer on-line systems, software, hardware, servers, access providers, computer equipment, program malfunctions or other errors, failure of any entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, that are human or technical in nature, including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any materials in this Giveaway. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Giveaway and randomly award the Prizes from among all eligible entries prior to action taken by Sponsor if Sponsor determines, in its sole discretion, that the proper play, integrity and/or feasibility of the Giveaway or any component thereof is impaired, corrupted or severely undermined by any event beyond its control, including but not limited to viruses, bugs, fire, flood, health epidemic or crisis, earthquake, explosion, oil embargo, shortage or crisis, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor's control.  By participating in the Giveaway, entrant agrees to release Releasees from any losses, damages or injuries of any kind, without limitation, including death and bodily injury, due in whole or in part, directly or indirectly, from participation in the Giveaway or any Giveaway-related activity, or from entrants' acceptance, receipt, possession, use or misuse of any Prize.  Should this Giveaway be terminated prior to the stated expiration date, notice will be posted at www.ColemanRepellents.com. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Giveaway is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in this Giveaway or by any technical or human error, which may occur in the processing of the entries in this Giveaway. Automated entries are prohibited, and any use of such devices will cause disqualification. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the "authorized account holder" person in whose name the email account is registered, provided that person meets all eligibility criteria set forth in the "Eligibility" section of these Official Rules and complies with all other terms of these Official Rules. "Authorized Holder" shall mean the natural person assigned to an email address by an Internet access provider, on-line service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.  The email address submitted must be valid from the time of entry through 11:59 p.m. E.T. on August 31, 2010.   Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process.
  3. General Conditions.  Sponsor reserves the right to modify prize award procedures in its sole discretion at any time. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Giveaway materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference, and shall not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor.
  4. Governing Law/Jurisdiction.  This Giveaway is offered only in the United States and is governed by the laws of the state of Wisconsin. All participants in the Giveaway expressly consent, and submit themselves, to the jurisdiction of the courts of Wisconsin, and it is stipulated that venue shall be in Waukesha County for the adjudication or disposition of any claim, action, or dispute arising out of these Official Rules that is not subject to the Mandatory Arbitration Provision contained in Section 11 below.
  5. Mandatory Arbitration Provision. By participating in this Giveaway, each entrant agrees that any controversy or claim, whether based on contract, tort, statute or other legal or equitable theory (including but not limited to any claim of fraud, misrepresentation or fraudulent inducement or any question of validity or effect of these Official Rules including this Section) arising out of or related to the Giveaway or these Official Rules (including any amendments, annexations, and extensions) or the breach thereof (“Claim”) will be resolved only through binding arbitration if the parties are unable to resolve the dispute informally amongst themselves.  Written notice of the Claim shall be provided to the other party.  After such notice is provided, entrant and Sponsor or its designee shall attempt in good faith to settle the Claim.  In the event the parties are unable to resolve the Claim within sixty (60) days (or such longer period as extended by mutual agreement of the parties), then such Claim shall be resolved by binding arbitration in accordance with the then current AAA Commercial Arbitration Rules and Mediation Procedures (“AAA Rules”) and this provision.  The arbitration shall be governed by the Federal Arbitration Act, 9 U.S.C. §§ 1, et seq., to the exclusion of any provision of state law inconsistent therewith or which would produce a different result.  Judgment upon the award rendered by the arbitrator may be entered by any court having jurisdiction.  There shall be one arbitrator.  The arbitrator shall determine the Claim of the parties involved and render a final award.  The arbitrator shall set forth the reasons for the award in writing.  In addition, if the entrant demonstrates that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the entrant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive.
  6. Winner List. For the name of the winners, send a self-addressed stamped legal size envelope by August 31, 2011 to: Bugsy’s Great Gear Giveaway, c/o Celtic, Inc., 330 Executive Dr. Suite 206, Brookfield, WI 53005. Celtic, Inc. assumes no responsibility for lost, late, illegible, incomplete or postage due mail.  Winners’ names will be mailed when all winners have been verified.
  7. Privacy. By entering and providing the required entry information, you acknowledge that Sponsor may also send you information, samples or special offers it thinks may be of interest to you offered by Sponsor. If you do not wish to share your information, please do not enter this Giveaway.  Sponsor will be collecting personal data about entrants in accord with the privacy policy posted at http://colemanrepellents.com/privacy.php.  By participating in this Giveaway, entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read, reviewed and accepted the privacy policy posted at http://colemanrepellents.com/privacy.php.
  8. Limitation of Liability / AS-IS.  SPONSOR AND THE RELEASEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES OR ANY LOST DATA, LOST PROFITS, OR ECONOMIC LOSS AS A RESULT OF ANY BREACH OR DEFAULT BY THEM WITH RESPECT TO THE GIVEAWAY, WHETHER ARISING IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE.   The Giveaway is offered in its "AS-IS" condition as available from time to time during the Giveaway period.

  10. Social Media. This Giveaway is in no way sponsored, endorsed or administered by, or associated with, Facebook or any other social media sites through which it may be promoted or administered.  You understand that you are providing your information to Sponsor and not to Facebook or other applicable social media sites.  The information you provide will be used by Sponsor only as provided for in Section 13.
  11. Electronic Acceptance. By clicking on the "I Agree" button below, you (a) represent that you agree to be bound by these Official Rules, (b) agree that you are providing the legal equivalent of your handwritten signature, and (c) agree to print and/or save a copy of these Official Rules for your records.  If you do not agree to be bound by the Official Rules, please click the "Cancel" button below and do not register for the Giveaway.
